The first error to fix is the span element around the menu ul element. Spans cannot contain HTML structures. Change the span to a division.

Wave did not detect accessibility errors. Cynthia Says it is US 508 compliant as far as a computer can check. The TV US 508 test starts with the XHTML test and will reject the XHTML.
